How the calculation works

1. The regular hourly rate

Divide the salary by the divisor: weekly hours × 5. For 44 hours a week, the divisor is 220; for 40 hours, 200 (TST Precedent 431); for 36 hours, 180.

2. The overtime premium

The Constitution guarantees at least 50% on top of the regular hour (art. 7, XVI). Sundays or holidays worked without a compensatory day off are paid double, 100% (Law 605/1949 and TST Precedent 146). Collective agreements may set higher rates. The limit is 2 overtime hours a day (CLT, art. 59).

3. The night premium

For urban work from 10 pm to 5 am, the premium is at least 20% of the regular hour, and the night hour lasts 52 minutes and 30 seconds: 7 clock hours count as 8 (CLT, art. 73). In rural work the premium is 25%, with no shorter hour (Law 5,889/1973).

4. The weekly rest (DSR) effect

Regular overtime and night premium also raise the paid weekly rest: add the month's amounts, divide by the working days (Monday to Saturday, without holidays) and multiply by the Sundays and holidays (TST Precedents 172 and 60).

In short: overtime = salary ÷ divisor × (1 + premium) × hours; DSR = total ÷ working days × Sundays and holidays.

Worked example

Salary of R$ 2,200.00, 44-hour week, 10 overtime hours on working days, 4 hours on a holiday and 7 hours of night work, in a month with 25 working days and 5 Sundays and holidays:

  1. Regular hour: R$ 2,200.00 ÷ 220 = R$ 10.00.
  2. Hours at 50%: R$ 15.00 × 10 h = R$ 150.00.
  3. Holiday at 100%: R$ 20.00 × 4 h = R$ 80.00.
  4. Night premium: 7 clock hours become 8 hours; 20% of the regular hour on each = R$ 16.00.
  5. DSR: R$ 246.00 ÷ 25 × 5 = R$ 49.20.
  6. Monthly total: R$ 295.20.

Frequently asked questions

How is the overtime rate calculated?

Divide the salary by the divisor (220 for a 44-hour week) and add the premium: 50% on working days and 100% on Sundays and holidays. With a R$ 2,200 salary, the regular hour is R$ 10 and overtime at 50% is R$ 15.

What is the divisor for a 40-hour week?

200. The divisor is always weekly hours × 5: 220 for 44 hours, 200 for 40 hours and 180 for 36 hours.

How much is overtime on Sundays?

Sundays and holidays worked without a compensatory day off are paid double: a 100% premium on the regular hour, unless a collective agreement sets more.

What is the shorter night hour?

For urban work between 10 pm and 5 am, each night hour lasts 52 minutes and 30 seconds. So 7 clock hours count as 8, and all of them get the premium of at least 20%.

Does overtime affect the paid weekly rest (DSR)?

Yes, when it is regular. The effect is the month's overtime divided by working days and multiplied by Sundays and holidays. It also counts toward vacation, 13th salary and FGTS.

How many overtime hours are allowed per day?

Up to 2 hours a day (CLT, art. 59), except for exceptional cases set by law. With an hour bank, they may be offset with time off instead of paid.
